Estimate only, not legal advice. Payments are set off against the oldest instalments first, interest is simple interest from each instalment's due date, capped by the in duplum rule, at one rate for the whole period.

How It Works

How maintenance arrears are calculated

1. Add up every instalment that fell due

An order of R 3,000 a month from January 2025, with a 6% annual increase, means 12 × R 3,000 for 2025 and R 3,180 a month from January 2026.

2. Subtract what was actually paid

Payments are set off against the oldest unpaid instalments first, so the most recent months are the ones that stay unpaid.

3. Add interest on each unpaid instalment

Interest at the prescribed rate (repo + 3.5%) runs from each instalment's due date, and can never be more than the unpaid capital it accrued on.

You have a number. Now what?

Take your calculation to the maintenance court that made the order and apply for enforcement on Form K (J306) under section 26 of the Maintenance Act. Bring the order, your bank statements showing what was received, and this breakdown. The court can then:

  • Attach their salary with an emoluments attachment order, so the employer pays you directly
  • Attach money owed to them, such as a pension payout or a debt
  • Issue a warrant of execution against their property

Failing to pay maintenance is also a criminal offence. Read more in our guides to calculating arrears, enforcing a maintenance order and what to do when your ex doesn't pay. If there is no order yet, start with Form J101.
