Terms of Use
Last updated: 16 October 2026
These terms govern your use of mmaintenance.co.za and its tools (the "Service"), provided by MMaintenance ("we", "us"). By creating an account, buying an export or subscribing, you agree to these terms, our Privacy Policy and our Refund Policy. If you do not agree, please do not use the Service.
Some clauses limit our liability or place obligations on you; they are shown in bold and you should read them carefully, as the Consumer Protection Act 68 of 2008 requires us to draw them to your attention.
1. What MMaintenance is, and is not
MMaintenance is a calculation and document-preparation tool. It helps you list monthly expenses, apportions shared household costs using the portions method (two portions per adult and one per child), divides contributions in proportion to each party's income, and produces schedules, Rule 43 budgets and Form J101 documents.
MMaintenance is not a law firm and does not give legal, financial or tax advice. Using the Service does not create an attorney-client relationship. The portions method is a commonly used approach, not a rule of law: courts decide maintenance on the facts of each case and may apply a different method. You are responsible for the accuracy of the information you enter and for reviewing every document before you sign, serve or file it. If your matter is complex, contested or urgent, please consult a qualified legal practitioner.
2. Your account
- You must be at least 18 years old and give accurate details when you register.
- Sign-in uses one-time codes sent to your email or phone. Keep access to those secure; you are responsible for activity on your account, and must tell us promptly if you believe someone else has used it.
- Members of the same firm or practice may share one Legal Professional Plan account. The account holder is responsible for everyone who uses it, and for making sure each of them follows these terms.
3. Prices, payments and subscriptions
- Creating and viewing schedules is free. Downloading a schedule's exports is a once-off payment of R149 per schedule.
- The Legal Professional Plan costs R499/mo, billed in advance, and renews automatically each month until you cancel. You can cancel at any time in your account; you keep access until the end of the period you have paid for.
- Prices are in South African Rand and are shown on the pricing page before you pay. We may change prices for the future; subscribers will be told by email at least 30 days before a change takes effect, and may cancel before then.
- Payments are processed securely by Paystack. Refunds and cancellations are handled under our Refund Policy, which does not limit your rights under the Consumer Protection Act or the Electronic Communications and Transactions Act.
4. Free first month
Where offered, a new Legal Professional account can try the plan free for 30 days. No card is needed, one free month is available per person or firm, and the trial simply ends after 30 days; you will not be charged unless you choose to subscribe. We may withdraw the offer for new sign-ups at any time, and may end a trial that is being misused (for example, repeated trials through new accounts).
5. Legal practitioners
If you use the Service for clients, you confirm that:
- you have a lawful basis under POPIA to process your clients' personal information, including any identity numbers, and that you will comply with your professional obligations of confidentiality;
- you are the responsible party for your clients' information and we act as your operator, as described in section 7 of our Privacy Policy; and
- you remain professionally responsible for any document you prepare with the Service and for the advice you give your clients.
6. Acceptable use
You agree not to:
- use the Service for anything unlawful, or to prepare documents you know to be false or misleading;
- upload another person's personal information or bank statements unless you are entitled to do so;
- try to gain unauthorised access to the Service, other accounts or our systems, or interfere with their security or performance;
- copy, scrape, resell or reverse-engineer the Service, or use automated means to access it, except as we allow; or
- share your account with people outside your own household or firm, or let others get around payment for exports or the subscription.
We may suspend or close an account that breaches these terms, and will tell you why unless the law or a security risk prevents it.
7. Your content and AI features
- You own the information you enter and the documents you create. You allow us to store and process it only to provide, secure and improve the Service, as described in our Privacy Policy.
- The bank statement import uses artificial intelligence to suggest transactions and categories. Suggestions can be wrong or incomplete; check them before you approve them.
- If you create a share link for a schedule, anyone with the link can view it. You are responsible for who you share it with, and can switch it off at any time.
8. Our intellectual property
The Service, its software, calculations, templates, text, design and the MMaintenance name and logo belong to us or our licensors. You may use the documents you generate for your own matters and your clients' matters, but you may not copy or redistribute the Service itself.
9. Availability and changes
We work to keep the Service available and accurate, but it may sometimes be unavailable for maintenance or for reasons beyond our control. We may improve or change features over time. If we discontinue a paid feature, we will give subscribers reasonable notice.
10. Limitation of liability
To the extent the law allows, the Service is provided "as is", and we are not liable for any indirect or consequential loss, or for loss arising from the outcome of a legal matter, from information you entered, or from a document you did not review. Our total liability to you for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for our gross negligence or wilful misconduct, or your rights under the Consumer Protection Act.
11. Indemnity
You agree to indemnify us against third-party claims arising from your breach of these terms or your unlawful use of the Service, including processing another person's information without a lawful basis.
12. Ending your use of the Service
You can stop using the Service and delete your account at any time under Account Settings. Deleting your account permanently erases your schedules and client records, so download anything you need first. Sections 7 to 11 continue to apply after your account ends.
13. Governing law and disputes
These terms are governed by the law of the Republic of South Africa. Please contact us first so we can try to resolve any complaint informally. If we cannot, either party may approach a competent South African court, and you may also use any complaint channel available to you under the Consumer Protection Act.
14. Changes to these terms
We may update these terms from time to time. The "last updated" date above shows when they last changed. We will email account holders about significant changes before they take effect; continuing to use the Service after that means you accept the updated terms.
